Terms of Service

1. Services Offered

Triflex Media offers digital agency and creative production solutions, including but not limited to:

• Digital Performance Marketing & Media Acquisition
• Content Production & Cinematic Video Campaigns
• 3D Animation & Visual Effects (VFX)
• Strategic Branding & Identity Systems
• Web Design & Software Development
• AI Integration & Workflow Pipeline Automations

2. Payment & Retainers

A deposit is required before any campaign strategy, rendering, or production work commences. The remaining contract balance is due upon project completion or deliverable sign-off. Late payments are subject to additional service fees as defined in individual service contracts.

3. Intellectual Property

Upon receipt of full payment, clients own the final media deliverables and creative assets produced for their campaigns.

• Portfolio Rights: Triflex Media retains the right to display all project highlights, case study metrics, and visual deliverables in our portfolio unless a custom NDA is explicitly signed.
• Agency Tools: Triflex Media retains full ownership of any underlying proprietary software, 3D project scripts, templates, custom workflows, or methodologies used in producing the deliverables.

4. Revisions

A specified number of feedback and revision rounds are included in each project scope of work. Any additional edits, modifications, or scope additions beyond the initial contract will be billed at our standard hourly rate.

5. Confidentiality

Both parties agree to protect and keep confidential any proprietary information, client data, business metrics, or source assets disclosed during the contract period.

6. Liability Limits

Triflex Media's liability is strictly limited to the amount paid for the specific service under dispute.

• We are not liable for any indirect, incidental, or consequential damages.
• We do not guarantee specific monetary returns, search engine rankings, or advertising outcomes as market performance is subject to external forces.

7. Client Responsibilities

To achieve optimal results, clients agree to:

• Provide accurate, complete information regarding their business and goals
• Deliver timely feedback, project source assets, and required approvals
• Ensure they hold all necessary intellectual property rights to any materials provided to Triflex Media

8. Termination

Either party may terminate a project or recurring contract by providing a 30-day written notice. Project deposits are non-refundable unless Triflex Media fails to commence work.

9. Governing Law

These Terms of Service are governed by the laws of the State of Texas, United States. Any legal disputes arising under these terms shall be resolved exclusively in the courts of San Antonio, Texas.
